... and What Happened?

Outcome of the Zoning Board of Appeals Hearing

ZONING BOARD OF APPEALS  - June 13, 2007

1. Appeal # 07-01 – Appeal of the decision made by the Foster Planning Board regarding the approval of the preliminary plan for the proposed minor subdivision applied for by John Pagliaro, Intrica Group LLC, Plat 4, Lot 87, corner of Harrington and Cucumber Hill Road. Appeal was filed by the abutting property owners based on Section XVI of the Foster Subdivision Regulations and Article XII of the Foster Zoning Ordinances.

ZONING BOARD RETURNS SUBDIVISION TO PLANNING BOARD - July 11, 2007

The Zoning Board voted to return the Preliminary Approval of the Harrington Subdivision to the Planning Board based on the fact that they found errors in the review process by which the Planning Board arrived at their decision. Effectively, this means that the Planning Board will take a second look at several requirements that the developer must meet and will render a revised decision. It is not a guarantee that fewer lots will be approved. It is a guarantee that greater scrutiny will be given to the application.

FPS WILL CONTINUE TO MONITOR THIS DEVELOPMENT

The Zoning Board has decided to review all of the evidence brought before them by the abutters who filed the Appeal to the Planning Board's decision.
